Law Firm Lawyeon represented a Vietnamese national investigated in connection with drug delivery and secured a decision not to prosecute the allegation of drug use.
The client became involved in drug delivery through acquaintances while staying in Korea without lawful immigration status. During police questioning, the client had difficulty explaining their circumstances in Korean and had made an admission concerning drug use.
Attorneys S.H. Bong and S.C. Kim met with the client and attended questioning from the early stages of the investigation. Working with interpreters, Lawyeon reviewed the client’s account and statements to prepare the defense.
Counsel argued that the evidence of drug use was insufficient: the preliminary drug test was negative, and there was no objective evidence of drug use beyond the client’s admission.
The investigating authority accepted counsel’s submissions and decided not to prosecute the drug-use allegation.
In the trial proceedings relating to drug delivery, attorney D.H. Nam presented the treatment needs of the client’s young child in Vietnam, the client’s financial circumstances, and the immigration consequences of criminal punishment as mitigating factors.
