Overview
Changes in nationality, passport details, marriage or family relationships may affect an existing immigration status and the records held in Korea. Where new identity documents do not resolve the issue, the previous permissions and registrations, the timing of the change and the connections between official records must be examined.
Lawyeon advises on residence and permanent residence, overseas Korean status, the acquisition, loss and reinstatement of Korean nationality, and changes to foreign resident registration. Where earlier records differ from the client's current identity or the continuing validity of a status is disputed, we review proof of identity, the status itself and the documents required for reporting or correction.
Our Practice
Residence, permanent residence and maintaining status
We assess changes to residence or permanent residence status for applicants who have lived in Korea through employment or business. We review the residence history, income and means of support, conduct and basic knowledge evidence required for the relevant application category.
Where a marriage ends or a spouse's status changes after the family has settled in Korea, we examine whether residence can be maintained or a change of status sought in light of the family's current circumstances, including the care of children. The basis for each family member's residence is assessed separately.

Korean nationality and overseas Koreans
We handle the acquisition and reinstatement of Korean nationality, reports of loss of Korean nationality following foreign citizenship acquisition, and overseas Korean status. We examine the reason and timing of the nationality change together with Korean family registration records and foreign identity documents to identify the necessary reports and applications.
Where nationality selection or multiple nationality is also at issue, we review how Korean nationality was acquired, when foreign nationality was obtained and the reporting history. For clients considering reinstatement after residence as an overseas Korean, we identify the documents for each procedure in light of their current nationality and plans for living in Korea.

Foreign resident registration and immigration records
When a foreign national enters Korea using a passport of a new nationality, or their name or passport details change, we review how the earlier foreign resident registration should be connected to the current identity documents. We compare permission, registration and travel records to confirm identity and identify the entries requiring an update or correction.
Where the immigration authority takes a different view on the continuing validity of a status or the possibility of changing registration details, we examine the basis and supporting records and prepare legal submissions. We review the receipt and acceptance of the report and any written notice, coordinating with the administrative disputes practice where a refusal needs to be challenged.
