Administrative Disputes & Claims

EXPERTISE

Overview

Responding to a refusal of immigration permission or a report requires an examination of both the applicant's eligibility and the grounds on which the authority acted. We review the application and supplementary submissions, the notice, the applicable grounds and the evidence to identify the issues that can be challenged.

Lawyeon handles administrative appeals and litigation relating to immigration, access to records and legal submissions, and administrative claims for clients abroad. We also examine rights to Korean pension benefits and investment funds remaining after departure or a nationality change, coordinating documents prepared overseas with the claim in Korea.

Our Practice

Administrative appeals and immigration litigation

We handle administrative appeals and litigation concerning immigration decisions, including visa or residence refusals, removal measures and refusals to accept reports. We obtain the application, supplementary submissions and decision records to assess factual errors, interpretation of requirements, procedure and the exercise of discretion.

We consider whether a supported reapplication or a challenge seeking cancellation of the existing decision is appropriate, and develop the claim and evidence accordingly. Where enforcement may cause harm, we assess whether interim relief, including suspension of enforcement, is needed alongside the main claim.

Our PracticeObtaining and reviewing decision records · Administrative appeals · Cancellation proceedings · Suspension of enforcement

National Pension and investment fund refund claims

We handle claims for National Pension lump-sum refunds for foreign nationals who have left Korea and repayment of deposits held under investment immigration programs. We review payment conditions, changes in the claimant's identity, proof of entitlement and the receiving account.

For clients pursuing a claim from abroad, we review the power of attorney, notarization, apostille or consular authentication, and documents required for overseas remittance. Where nationality or passport details have changed, we also assess the evidence connecting the current applicant to the original rights holder.

Our PracticeNational Pension lump-sum refunds · Investment deposit repayment · Overseas powers of attorney and authentication · Receipt abroad
